A. INTRODUCTION

NodeActa is committed to safeguarding the privacy and security of your Personal Data. For the purposes of this Privacy Policy, “Personal Data” refers to any information that enables NodeActa to identify you, directly or indirectly. This Privacy Policy sets forth NodeActa’s policies and practices regarding the collection, use, and protection of Personal Data obtained through the NodeActa.com domain, including but not limited to the “NodeActa Shop” and “NodeActa Forum” (collectively, the “Site”), as well as Personal Data collected through alternative channels such as telephone communications, trade shows, conferences, or through our authorized business partners.

This Privacy Policy governs NodeActa’s handling of your Personal Data in connection with your access to and use of the Site and any related software products and/or services provided by NodeActa. By accessing or using the Site and/or downloading, installing, or otherwise utilizing any NodeActa software, you hereby acknowledge and consent to the terms and conditions set forth in this Privacy Policy, in addition to agreeing to be bound by the NodeActa Website Terms of Use, where applicable.

If you do not agree to the terms of the Privacy Policy or the data practices described herein, you must refrain from accessing or using the Site, NodeActa software, Subscription Services, NodeActa Cloud, NodeActa Demo Sites, or any related services, and from downloading any materials therefrom.

Subject to applicable law, NodeActa reserves the right to amend or update the Privacy Policy at its sole discretion and at any time. Upon making such amendments, the “Last Updated” date at the end of the Privacy Policy shall be revised accordingly.

You are encouraged to review the Privacy Policy in its entirety. Should you have any questions or concerns regarding the Privacy Policy, you may contact NodeActa by email or postal mail using the contact information provided therein.

B. HOW WE COLLECT PERSONAL DATA

NodeActa may collect Personal Data in a number of ways. The most common are when you buy a license in NodeActa Online Store, when you subscribe to e-mail newsletters, when you enter data, upload data files, and manipulate data, when you create an account or post to the Forums, when you report a problem with our Site or our software products. NodeActa may also receive Personal Data about you from other business channels such as telephone calls, trade shows, conferences, product demonstrations, service engagements, or from our partners.

NodeActa typically collects Personal Data supplied by the customer to provide a product or service or as part of a purchase, activation and registration. This information typically includes but is not limited to the customer e-mail address, name, company, organization or location. Our order forms in the NodeActa Online Shop are handeled by a third party payment service (paddle.com) and we personally do not collect and store customers’ financial information such as credit card number and other billing information, which are used to process your order. All of the data that moves between your browser and NodeActa Site is transmitted over an encrypted channel using at least TLS 1.2 (Transport Layer Security) encryption to guard your data against abuse.

NodeActa collects the information submitted via the NodeActa Online Support Center and technical incident support form to better serve our customers. NodeActa collects data about the Site visitors which may identify the visitor in our server log files, cookies and web beacons as described below.

During purchased license activation, the NodeActa software will connect to the NodeActa.com Server and convey information such as the operating system hosting the software, IP address, the DNS, UUID, date and start time of the initial session execution, and software key code, name and version.

C. HOW WE USE YOUR PERSONAL DATA

NodeActa uses your Personal Data, in addition to the data that is collected but that falls outside of the definition of Personal Data, to help create and deliver content, products, and services relevant to you; to help us personalize or enhance your experience on our Site; to help you find or purchase software, services or information on our Site; to provide you with assistance or respond to your inquires; to fulfill orders, process payments or perform a credit check, as necessary; for interactive communications with you about our products or services; to relieve you from having to provide your Personal Data more than once; in order to prevent unlicensed or illegal use of NodeActa software; to notify you by email, telephone or other medium about product upgrades, updates, special offers and other new services or software offerings (you will be able to unsubscribe from emails by following the instructions at the bottom of our message); to help us manage and administer our Site.

The data about our users and visitors that NodeActa collects is important to us and we do not sell it to other parties. Except in the limited circumstance set forth below, NodeActa will disclose Personal Data, without notice, only if required to do so by law or in the good faith belief that such action is necessary to: (a) comply with the law, subpoena, court order or other legal process; (b) protect and defend the rights or property of NodeActa and its family of websites; and (c) protect the personal safety of users of NodeActa Site or the public.

In certain limited circumstances, NodeActa may engage third-party entities to perform specific services on its behalf, including but not limited to responding to customer inquiries regarding products or services, handling packaging, mailing, and delivery of purchases, processing payment transactions, and administering event registrations. Such third-party service providers shall be granted access solely to the personal data necessary to perform their designated functions and shall be contractually bound to use such data exclusively for the provision of said services. Furthermore, such providers shall be required to implement appropriate safeguards to protect the confidentiality and integrity of any personal data received.

In the event that a user initiates a purchase or service transaction through a third-party entity affiliated with or accessible via the Site, NodeActa may disclose limited personal information to such third party strictly for the purpose of effectuating and completing the transaction. Such disclosure shall not, under any circumstances, be deemed to constitute a sale, lease, unauthorized disclosure, or other form of commercial exploitation of personal information in violation of the terms and commitments set forth in this Privacy Policy.

In the event of a merger, acquisition, sale, or other transfer of control of NodeActa, whether in whole or in part, any personal data held by NodeActa may be transferred as part of the transaction. Such transfer shall be conducted in accordance with applicable data protection laws and remain subject to the provisions of this Privacy Policy.

Please be advised that NodeActa maintains archival copies of its system logs, databases, and related data repositories. Such archives may retain certain data following deletion from the active database. These archival records are preserved for purposes including, but not limited to, disaster recovery, legal compliance, administrative functions, and other non-commercial, non-marketing activities. NodeActa does use other data that we collect from the NodeActa Demo Sites, our server log files, cookies and web beacons to get a better understanding of our visitors and customer base in order for us to enhance our Site, software and services. This data is collected, compiled and analyzed on an aggregate basis and does not identify you personally. This data helps us to determine the content that provides value to our customers and visitors.

NodeActa is not a controller, joint controller, or processor for any customer or end user, as those terms are defined or used by the GDPR, CCPA, or any similar legislation.

NodeActa does not collect or asks for: age (except for the confirmation you are not a minor), race, color, ancestry, national origin, citizenship, religion or creed, marital status, medical condition, physical or mental disability, sex, gender, gender identity, gender expression, pregnancy or childbirth and related medical conditions, sexual orientation, military status, genetic information.

D. HOW WE PROTECT AND STORE YOUR PERSONAL DATA

NodeActa has security measures in place to protect the loss, misuse and alteration of your Personal Data under our control. These include a firewall to prevent unauthorized access to our systems. Inside NodeActa, Personal Data is stored in password-controlled servers with limited and controlled access on a need-to-know basis. When NodeActa software, communicates with the NodeActa.com Server, all communications are transmitted via at least TLS 1.2 encryption. While we cannot guarantee that loss, misuse or alteration to data will not occur, we take many precautions to prevent such unfortunate occurrences. However, NodeActa accepts no liability for any unintentional disclosure. Except under conditions explained in the Privacy Policy, your Personal Data is never shared outside NodeActa.

No Personal Data of individuals who are citizens or residents of the European Union, as collected in accordance with this Privacy Policy, shall be processed, collected, transmitted, stored, or analyzed outside the territorial boundaries of the European Union. For the purposes of the foregoing, the terms “Personal Data” and “Processed” shall have the meanings ascribed to them under the General Data Protection Regulation (EU) 2016/679 ("GDPR").

You hereby represent and warrant that you have full authority, right, and legal capacity to disclose and provide NodeActa with the data referenced in the Privacy Policy, including any data pertaining to third parties. You further represent and warrant that such data does not infringe upon or misappropriate any patent, copyright, trade secret, or other proprietary rights of any third party, nor does it violate any applicable data protection, privacy, or similar laws or regulations.

By registering an account on the Site, you may be issued a password enabling access to certain areas or features of the Site. You acknowledge and agree that you are solely and fully responsible for maintaining the confidentiality and security of your login credentials, including your password, and for any and all activities conducted through your account, whether or not such use is authorized by you. You agree to promptly notify us of any actual or suspected unauthorized use of your account or any other breach of security. We strongly advise that you do not disclose your password to any third party and exercise reasonable care in the use and storage of your credentials.

E. YOUR DATA RIGHTS AND DELETITION REQUEST

Under the General Data Protection Regulation (GDPR), you have the right to request the deletion of your personal data held by us at any time.
You may request the deletion of your personal data by contacting us via one of the following methods:

To protect your privacy, we may require you to verify your identity before processing your request. This may involve confirming your email address, answering security questions, or other methods. We will respond to your request within 30 days. In some cases, if the request is complex or we receive a high volume of requests, we may extend this period by an additional 60 days, and we will notify you accordingly.
Once your request is verified and processed, your personal data will be permanently deleted from our systems unless we are required to retain certain information by law. You will no longer be able to access your account or use services that require your data.

F. HOW WE USE COOKIES

In addition to the Personal Data collected during the registration process, NodeActa may also collect information through automated means, including but not limited to the use of “cookies”. Such technologies are employed to enhance the functionality of the Site, facilitate content delivery that is responsive to user preferences, and personalize the user experience.

A "cookie" is a small text file containing a unique identifier, which is transferred to a user’s device to enable recognition of the user’s browser and to passively collect information regarding the user’s interactions with the Site. Users acknowledge that communications in such areas may be accessed, collected, and used by third parties beyond NodeActa’s control. Accordingly, users are advised to exercise caution and discretion when disclosing personal or sensitive information online.
