A. INTRODUCTION
NodeActa is committed to safeguarding the privacy and security of your Personal Data. For the purposes of this Privacy Policy, “Personal Data” refers to any information that enables NodeActa to identify you, directly or indirectly. This Privacy Policy sets forth NodeActa’s policies and practices regarding the collection, use, and protection of Personal Data obtained through the NodeActa.com domain, including but not limited to the “NodeActa Shop” and “NodeActa Forum” (collectively, the “Site”), as well as Personal Data collected through alternative channels such as telephone communications, trade shows, conferences, or through our authorized business partners.
This Privacy Policy governs NodeActa’s handling of your Personal Data in connection with your access to and use of the Site and any related software products and/or services provided by NodeActa. By accessing or using the Site and/or downloading, installing, or otherwise utilizing any NodeActa software, you hereby acknowledge and consent to the terms and conditions set forth in this Privacy Policy, in addition to agreeing to be bound by the NodeActa Website Terms of Use, where applicable.
If you do not agree to the terms of the Privacy Policy or the data practices described herein, you must refrain from accessing or using the Site, NodeActa software, Subscription Services, NodeActa Cloud, NodeActa Demo Sites, or any related services, and from downloading any materials therefrom.
Subject to applicable law, NodeActa reserves the right to amend or update the Privacy Policy at its sole discretion and at any time. Upon making such amendments, the “Last Updated” date at the end of the Privacy Policy shall be revised accordingly.

B. HOW WE COLLECT PERSONAL DATA
NodeActa may collect Personal Data through various channels. The most common include purchasing a license from the NodeActa Online Store, creating an account or posting in the Forums, and reporting issues with our web site or software products.
NodeActa typically collects Personal Data supplied by the customer to provide a product or service or as part of a purchase, activation and registration. This information typically includes but is not limited to the customer e-mail address, name, company, organization or location. Our order forms in the NodeActa Online Shop are handeled by a third party payment service (paddle.com) and we personally do not collect and store customers’ financial information such as credit card number and other billing information, which are used to process your order. All of the data that moves between your browser and NodeActa Site is transmitted over an encrypted channel using at least TLS 1.2 (Transport Layer Security) encryption to guard your data against abuse.
NodeActa collects the information submitted via the NodeActa Online Support Center and technical incident support form to better serve our customers. NodeActa collects data about the site visitors which may identify the visitor in our server log files, cookies and web beacons as described below.
During purchased license activation, the NodeActa software will connect to the NodeActa.com Server and convey information such as the customer unique ID, date and time of the license activation, license key code, type and number of licenses.
C. HOW WE USE YOUR PERSONAL DATA
NodeActa uses Personal Data, as well as other data not falling within the definition of Personal Data, for the following purposes:
(a) To create, deliver, and maintain content, products, and services relevant to you,
(b) To personalize and enhance your experience on the Site,
(c) To assist you in locating or purchasing software, services, or information,
(d) To provide customer support and respond to inquiries,
(e) To fulfill orders, process payments, and, where applicable, conduct credit checks,
(f) To communicate with you regarding our products or services,
(h) To prevent the repeated entry of Personal Data,
(i) To detect, prevent, and address unlicensed or unlawful use of NodeActa software,
(j) To notify you, by email, telephone, or other means, of product upgrades, updates, promotional offers, and other new services or software, offerings (with the option to unsubscribe from email communications via the instructions provided in each message)
(k) To manage, administer, and improve the Site.
NodeActa does not sell Personal Data to third parties. Personal Data may be disclosed without prior notice only where required by applicable law or where NodeActa, in good faith, determines such disclosure is necessary to:
(a) comply with applicable law, legal process, subpoena, or court order,
(b) protect and defend the rights, property, or interests of NodeActa and its affiliated websites or
(c) protect the personal safety of users of the Site or the public.
NodeActa may, in limited circumstances, engage third-party service providers to perform specific functions on its behalf. Such functions may include, without limitation, responding to product or service inquiries, handling packaging, mailing and delivery of purchases, processing payment transactions, and administering event registrations. These providers shall be granted access solely to the Personal Data necessary to perform their assigned functions, shall be contractually bound to use such data exclusively for such purposes, and shall be required to implement appropriate technical and organizational measures to safeguard such data.
Where a user initiates a purchase or service transaction through a third party affiliated with, or accessible via, the Site, NodeActa may disclose limited Personal Data strictly for the purpose of effecting and completing the transaction. Such disclosure shall not be deemed a sale, lease, unauthorized disclosure, or other commercial exploitation of Personal Data, as defined under this Privacy Policy.
In the event of a merger, acquisition, reorganization, sale, or other transfer of NodeActa, whether in whole or in part, Personal Data held by NodeActa may be transferred as part of such transaction. Any such transfer shall be carried out in compliance with applicable data protection laws and remain subject to this Privacy Policy.
NodeActa maintains archival copies of system logs, databases, and related data repositories. Such archives may retain certain data following deletion from active databases. Archival records are preserved for purposes including, but not limited to, disaster recovery, legal compliance, administrative requirements, and other non-commercial, non-marketing activities.
NodeActa also collects and analyzes data from Demo Sites, server log files, cookies, and web beacons in order to gain a better understanding of its visitor and customer base. This information is aggregated, non-identifiable, and used to enhance the Site, software, and services, and to determine which content is of greatest value to users.
NodeActa is not a controller, joint controller, or processor of customer or end-user data, as those terms are defined under the GDPR, CCPA, or any comparable legislation.
NodeActa does not request or collect information relating to age (other than confirmation that you are not a minor), race, color, ancestry, national origin, citizenship, religion or creed, marital status, medical condition, physical or mental disability, sex, gender, gender identity or expression, pregnancy or childbirth (including related medical conditions), sexual orientation, military status, or genetic information.
D. HOW WE PROTECT AND STORE YOUR PERSONAL DATA
NodeActa has security measures in place to protect the loss, misuse and alteration of your Personal Data under our control. These include a firewall to prevent unauthorized access to our systems. Inside NodeActa, Personal Data is stored in password-controlled servers with limited and controlled access on a need-to-know basis. When NodeActa software, communicates with the NodeActa.com Server, all communications are transmitted via at least TLS 1.2 encryption. While we cannot guarantee that loss, misuse or alteration to data will not occur, we take many precautions to prevent such unfortunate occurrences. However, NodeActa accepts no liability for any unintentional disclosure. Except under conditions explained in the Privacy Policy, your Personal Data is never shared outside NodeActa.
No Personal Data of individuals who are citizens or residents of the European Union, as collected in accordance with this Privacy Policy, shall be processed, collected, transmitted, stored, or analyzed outside the territorial boundaries of the European Union. For the purposes of the foregoing, the terms “Personal Data” and “Processed” shall have the meanings ascribed to them under the General Data Protection Regulation (EU) 2016/679 ("GDPR").
You hereby represent and warrant that you have full authority, right, and legal capacity to disclose and provide NodeActa with the data referenced in the Privacy Policy, including any data pertaining to third parties. You further represent and warrant that such data does not infringe upon or misappropriate any patent, copyright, trade secret, or other proprietary rights of any third party, nor does it violate any applicable data protection, privacy, or similar laws or regulations.
By registering an account on the Site, you may be issued a password enabling access to certain areas or features of the Site. You acknowledge and agree that you are solely and fully responsible for maintaining the confidentiality and security of your login credentials, including your password, and for any and all activities conducted through your account, whether or not such use is authorized by you. You agree to promptly notify us of any actual or suspected unauthorized use of your account or any other breach of security. We strongly advise that you do not disclose your password to any third party and exercise reasonable care in the use and storage of your credentials.
E. YOUR DATA RIGHTS AND DELETITION REQUEST

To protect your privacy, we may require you to verify your identity before processing your request. This may involve confirming your email address, answering security questions, or other methods. We will respond to your request within 30 days. In some cases, if the request is complex or we receive a high volume of requests, we may extend this period by an additional 60 days, and we will notify you accordingly.
Once your request is verified and processed, your personal data will be permanently deleted from our systems unless we are required to retain certain information by law. You will no longer be able to access your account or use services that require your data.
F. HOW WE USE COOKIES
In addition to the Personal Data collected during the registration process, NodeActa may also collect information through automated means, including but not limited to the use of “cookies”.
